Deploying Foxhole and ARO

Why does this not generate an ARO? 
My thought is because This:

As no Action was Performed in LOS... no ARO can happen

Note though that you can prepare your foxholes before you engage a target. This means thatyou can run up to a corner, still hiding from the enemy, then dig your Foxhole. With the change of silhouette size, you can use this to gain Line of Fire to your enemy, andthey won't be able to hit you with anunopposed shot. From there, with Partial Cover and Mimetism, you can spend a fresh Order to engage your target."
